 Main features of an effective trade mark

Section 2(zb) of the Trade Mark Act 1999 defines trade mark as a mark capable of being represented graphically and which is capable of distinguishing the goods or services of one person from those of others and may include shape of goods, their packaging and combination of colours.

An effective trade mark should have the following features:

  • It should be able to identify the product and it’s origin.
  • It should propose to guarantee its quality.
  • It should represent the product. As soon as one see the trademark, he/she should immediately identify the product.
  • It should advertise the product by giving an impression of the product
  • It creates an image of the product in the minds of the the consumers or the prospective consumers of such goods.
