Note: This section contains five questions. Attempt the five questions. Each question carries 4 marks 

1. Whether 'Tort' is a codified law. If not give one reason.
2. Complaint under Consumer Protection Act 1986.
4. What are essential elements in tort of malicious prosecution?
5. Whether motive and intention are relevant in law of torts?

Section B
Note: This section contains three questions. Attempt any two question. Each question carries 10 marks 
6. Define and discuss the the term 'service'. Discuss your answer with decided cases.
7. Distinguish between the following with the help of decided case law. False imprisonment and malicious prosecution.
8. Define 'Negligence'. What are the essential elements of tort of negligence? Explain with the help of appropriate examples.


Section C
Note: This section contains five questions. Attempt any three questions. Each question carries 20 marks 
9. If a person refuses to perform or becomes unable to perform the order of the District Forum, State Commission or National Commission, explain the different penalties given by them.
10. What do you understand by 'nuisance'? Explain its elements. Describe the different kinds of nuisance along with their remedies available.
11. Define libel and slander and discuss the saying "the greater the truth the greater the libel"
12. Discuss the rule laid down in Ryland Vs. Fletcher. Are there any exceptions to this rule? Discuss.
13. Discuss the liability of state for the torts committed by it's servents.  Whether the state will get sovereign immunity today? Discuss with Supreme Court cases.
