Section A
Note: Attempt all questions. Each question carries 4 marks

1. (a) Explain in Very brief "Res ipsa loquiyut"
(b) Write a distinction between Inevitable accident and Vis major.
(c) Define Consumer.
(d) Define defamation.

Section B
Note: Attempt any two question. Each question carries 10 marks

2.Define Tort. Discuss in brief the nature and characteristics of tort.
3. Explain the different penalties which can be given by District Consumer Forum, if a person refuses to perform it order.
4. 'A' digs a trench on his land near his boundary wall. A thief jumps over the wall at night landing himself o=in the trench and gets hurt. Discuss the liabilities of 'A' under the law of torts.

Section C
Note: Attempt any three question. Each question carries 20 marks

5. "The mere causing of actual loss to another is not necessarily a tort but the mere wrong without any actual loss is a tort". Discuss with the help of decided cases.
6. 'A' ad five other jointly participate in commission of a tort against 'B'. 'B' wishes to sue 'A' severally for the loss. Can 'B' do so? Can he also sue all the five persons and 'A' jointly. Discuss with the help of decided cases.
7. The tortious liability of the state has been shifted from civil tort to constitutional tort. Do you agree? Discuss with the help of decided cases.
8. "Harm suffered voluntarily is not actionable bt mere knowledge of the risk is not enough for the application of this rule." Discuss with the help of leading cases.
9. "The law takes on cognizance of carelessness, where there is no duty to take care". Discuss the statement in the light of decided case.
