An Agency of Necessity is created by an emergency where one person is forced to act on behalf of another to prevent loss or damage, without having the time to get formal authority.
Conditions for its existence (Section 189):
There must be an actual and imminent commercial necessity (e.g., protecting perishable goods).
It must be impossible to communicate with the principal to seek instructions.
The agent must act bona fide (in good faith) and in the best interest of the principal.
Example: A captain of a ship selling a cargo of fruit that is beginning to rot before reaching the destination port.
