Statutory Framework
Maintenance is primarily governed by two major pieces of legislation in India:
The Hindu Adoptions and Maintenance Act, 1956 (HAMA): This is a personal law that provides for maintenance during the subsistence of a marriage or after the death of a provider.
The Hindu Marriage Act, 1955 (HMA): Specifically Sections 24 and 25, which deal with maintenance during matrimonial disputes (divorce, judicial separation, etc.).
