Definition of Hindu as per Law

Under Section 2 of the Hindu Marriage Act, a "Hindu" includes:

  1. By Religion: Anyone following Hinduism (including Lingayats/Arya Samajis), Buddhism, Jainism, or Sikhism.

  2. By Birth: Children of Hindu parents or those raised as Hindus.

  3. By Conversion: Those who convert or re-convert.

  4. By Exclusion: Any Indian resident who is not a Muslim, Christian, Parsi, or Jew.

Scheduled Tribes are generally excluded unless specifically notified by the Central Government.

Note: Hindu Succession Act (1956), Hindu Minority and Guardianship Act (1956), and Hindu Adoptions and Maintenance Act (1956) also gives similar definition for the term Hindu.
