Duration of Copyright in case of Photograph

Under Section 25 of the Copyright Act, 1957, the duration of copyright for a photograph is 60 years.

Unlike literary works (which are linked to the author's lifespan), the term for photographs is calculated from the date of publication:

  • Timeline: 60 years from the beginning of the calendar year next following the year in which the photograph is published.

  • Example: If a photograph is published in 2026, the copyright protection will expire at the end of the year 2086 (60 years starting from January 1, 2027).
