Under the Indian Contract Act, 1872, a Bailor (the person delivering the goods) retains several rights to ensure their property is protected and handled according to the agreement.
The following are the primary rights of a bailor, summarized with their relevant sections:
1. Right to Terminate the Bailment (Section 153)
If the bailee performs any act regarding the goods bailed that is inconsistent with the conditions of the bailment, the bailor has the right to terminate the contract immediately.
Example: If you lend a horse for riding, but the bailee uses it to carry heavy loads, you can end the bailment.
2. Right to Claim Damages (Sections 154 & 156)
Unauthorized Use (Sec 154): If the bailee uses the goods in a manner not authorized by the contract, the bailor is entitled to compensation for any damage arising from such use.
Negligence (Sec 151/152): If the bailee fails to take "reasonable care" of the goods and they are damaged or lost, the bailor can claim damages.
3. Right to Separation of Goods (Sections 155–157)
If the bailee mixes the bailor's goods with their own:
With Consent (Sec 155): The bailor has an interest in the mixture in proportion to their share.
Without Consent (Separable) (Sec 156): The bailor can compel the bailee to bear the cost of separation and any damages.
Without Consent (Inseparable) (Sec 157): If the goods cannot be separated, the bailor is entitled to be compensated by the bailee for the total loss of the goods.
4. Right to Demand Return of Goods (Section 160)
The bailor has the right to have the goods returned or delivered according to their directions once the purpose of the bailment is accomplished or the time period has expired.
5. Right to Accretion/Increase (Section 163)
In the absence of any contract to the contrary, the bailor is entitled to any profit or increase which may have accrued from the goods bailed.
Example: If a cow is bailed and gives birth to a calf, the bailee must deliver both the cow and the calf to the bailor.
6. Right to Sue a Third Party (Section 180)
If a third party wrongfully deprives the bailee of the use or possession of the goods, or does them any injury, the bailor has the right to bring a suit against that third party, just as the owner would.
