Literal Meaning: Injury without damage.
This maxim applies when there is a violation of a legal right (Injuria) even if the person has suffered no physical harm or financial loss (Damnaum). In such cases, the person can still sue because the law values the protection of rights over the presence of actual loss.
Leading Case: Ashby v. White (1703) The plaintiff was a qualified voter who was wrongfully prevented from voting by a police officer. His preferred candidate won anyway, so he suffered no "loss." However, the court held that the violation of his legal right to vote was enough to award him damages.
