Damnum sine injuria

Literal Meaning: Damage without injury.

This is the opposite of the first maxim. It refers to a situation where a person suffers an actual loss or harm (Damnum), but no legal right has been violated (Injuria). Since no legal right was infringed, no action can be taken in court.

Leading Case: Gloucester Grammar School Case (1410) A schoolmaster set up a rival school next to the plaintiff’s school and charged lower fees. The plaintiff lost many students and suffered a huge financial loss. The court held that while the plaintiff suffered "damage," he had no "legal right" to prevent someone else from competing in a lawful business.
