Alternative Dispute Resolution (ADR) refers to a variety of methods used to resolve disputes outside the traditional courtroom. The goal is to reduce the burden on courts and provide faster, cheaper justice.
Examples of ADR Methods:
Arbitration: A private trial where a neutral third party (arbitrator) gives a binding decision.
Example: Two tech companies argue over a software patent. Instead of a 10-year court battle, they hire a retired judge to hear the case in 6 months.
Conciliation: A facilitator (conciliator) helps parties reach a compromise by suggesting solutions.
Example: A labor union and management disagree on wage hikes. A conciliator suggests a middle-ground percentage that both sides eventually sign as a "Settlement Agreement."
Mediation: A neutral party helps parties communicate to find their own solution (the mediator does not suggest solutions like a conciliator).
Example: A husband and wife in a divorce dispute use a mediator to decide on child custody and property division amicably.
Lok Adalat: A "People's Court" where pending court cases are settled through compromise.
Example: An insurance company and a car accident victim settle a compensation claim in a weekend Lok Adalat session to get an immediate payout.
