Juvenile Delinquency

Juvenile delinquency refers to criminal acts committed by individuals who are under the age of legal adulthood (usually 18). In India, this is governed by the Juvenile Justice (Care and Protection of Children) Act, 2015.

  • Nature: The law views a delinquent child not as a "criminal" but as a "child in conflict with the law."

  • Philosophy: The focus is on Reformation and Rehabilitation rather than Retribution. Juvenile offenders are not sent to regular jails but to Observation Homes or Special Homes.

  • The 2015 Amendment: Following the 2012 Delhi Gang Rape case, the law was amended to allow children between 16–18 years to be tried as adults if they commit "heinous offenses" (crimes with a minimum punishment of 7 years), subject to an assessment by the Juvenile Justice Board (JJB).
