UNCITRAL Model Law

The UNCITRAL Model Law (1985), with amendments adopted in 2006, was designed to assist states in reforming and modernizing their laws on arbitral procedure. It aims to create a uniform legal framework for the fair and efficient settlement of disputes arising in international commercial relations.

  • Key Features: It covers all stages of the arbitral process, from the arbitration agreement to the recognition and enforcement of the award. It limits court intervention and prioritizes Party Autonomy.

The Arbitration and Conciliation Act, 1996 (India) is primarily based on this Model Law, as stated in its Preamble, to ensure consistency with international standards.
