Domestic Arbitration

Domestic arbitration refers to arbitration proceedings conducted in India in accordance with Indian law, where the subject matter of the dispute and the parties involved are primarily Indian.

It is distinguished from International Commercial Arbitration by the identity of the parties. If none of the parties are foreign (as defined in Section 2(1)(f)), the arbitration is domestic. The procedure and the merits of the dispute are governed by the Arbitration and Conciliation Act, 1996, and the Indian Contract Act, 1872, respectively.
