Foreign arbitration refers to arbitration proceedings that take place outside the territory of India (the "seat" is in a foreign country). The resulting decision is known as a Foreign Award.
In India, foreign arbitration is primarily dealt with under Part II of the Arbitration and Conciliation Act, 1996. Specifically, Section 44 defines a foreign award as one made in a reciprocating territory (a country notified by the Indian government) under the New York Convention or the Geneva Convention. These awards are recognized and enforced in India provided they meet the conditions of commerciality and internationality.
