Dependent under the Workmen's Compensation Act, 1923

Now known as the Employee's Compensation Act, Section 2(1)(d) defines "dependent" into three categories to determine who is eligible for compensation in case of a fatal accident:
  1. Always Dependents: Widow, minor (legitimate or adopted) son, unmarried (legitimate or adopted) daughter, or a widowed mother.

  2. Dependents if actually dependent: If they were wholly or in part dependent on the earnings of the employee at the time of death: Includes a widower, a parent other than a widowed mother, a minor illegitimate son, an unmarried illegitimate daughter, etc.

  3. Others: A minor brother, an unmarried sister or widowed sister if a minor, a widowed daughter-in-law, etc.
