Under the Industrial Disputes Act (IDA), 1947, both Lay-off and Lockout involve a temporary stoppage of work, but they differ fundamentally in their causes, objectives, and legal consequences.
1. Lay-off: Section 2(kkk)
A lay-off occurs when an employer is unable to provide work to a workman whose name is on the muster rolls.
Causes: Shortage of raw materials, power, or coal; accumulation of stocks; breakdown of machinery; or natural calamities.
Nature: The business continues to operate, but certain workers are temporarily told not to report for duty.
Objective: To manage a temporary crisis until the business can resume normal operations.
Compensation: Under Section 25-C, a laid-off workman (with 1+ year of continuous service) is entitled to 50% of their basic wages and dearness allowance for the period of lay-off (up to 45 days in a year).
2. Lockout: Section 2(l)
A lockout is the refusal by an employer to continue employing their workers.
Causes: Usually arises from an industrial dispute, such as a disagreement over wages, a pending strike, or the need to pressure workers to accept management's terms.
Nature: The place of employment is temporarily closed or work is suspended entirely.
Objective: To coerce the employees into submitting to the employer's demands or to protect the establishment from violence during a strike.
Compensation: Payment during a lockout depends on its legality.
If the lockout is legal and justified, no wages are typically paid. If it is illegal or unjustified, the employer may be ordered to pay full wages for the lockout period.
Important Legal Conditions
Prior Permission: In establishments with 100 or more workmen (Chapters V-B of the Act), the employer must obtain prior permission from the "Appropriate Government" to lay off workers (except in cases of power shortage or natural calamity).
Public Utility Services: For lockouts in public utility services (e.g., water, electricity, railways), a mandatory 14-day notice must be given, and it cannot occur while conciliation proceedings are pending.
