Remedy for Refusal of Registration
If the Registrar refuses to register a Trade Union or cancels its registration, the aggrieved party has a legal remedy.
Section 11 (Appeals): Any person aggrieved by a refusal to register or by the withdrawal/cancellation of a certificate can file an appeal.
Jurisdiction:
If the head office of the Trade Union is in a Presidency-town, the appeal lies with the High Court.
In other areas, the appeal is filed before a Labour Court or an Industrial Tribunal, or such court (not inferior to a Court of an additional or assistant Judge of a principal Civil Court) as the government may appoint.
Outcome: The appellate court may dismiss the appeal or pass an order directing the Registrar to register the Union and issue a certificate.
