1. Differentiate between libel and slender. 
2. Define Trespass-ab-initio.  
3. Distinguish between 'Contract of Service' and 'Contract for Service'.
4. What is meant by 'Joint Tortfeasors'?
5. Define inevitable accident.

Section B
Note: Attempt any two question. Each question carries 10 marks

6. Harm suffered voluntarily is not actionable but mere knowledge of the risk is not enough for the application of this rule. Discuss.
7. A horse is left on the road with Leg tied. A scooterist runs it and injures it. Can the owner of the horse recover damages?
8. What are the defences open in an action based on nuisance?


Section C
Note: Attempt any three question. Each question carries 20 marks

9. "The mere causing of actual loss to another is not necessarily a tort but the mere wrong without any actual loss is a tort." Explain with the help of decided cases.
10. A says of a book published by Z— "Z's book is foolish; Z must be a weak man. Z's book is indecent; Z must be a man of impure mind." Can A be held liable for making defamatory statement against Z?
11. Who is a Consumer? What is meant by 'Deficiency in Service'? Explain with the help of decided cases.
12. In what classes of cases and on what grounds may one person sue and be sued for a tort committed to and by another?
13. Discuss the rule laid down in *Rylands vs Fletcher*. Are there any exceptions to this rule? Discuss.
