Maximum Punishment under IFA 1927

The Act provides various penalties depending on the nature of the offense (e.g., trespassing, setting fires, or illegal felling).

  • Standard Penalties: Most offenses in Reserved Forests (Section 26) or Protected Forests (Section 33) carry a punishment of imprisonment for a term which may extend to six months, or a fine which may extend to five hundred rupees, or both.

  • Compounding of Offenses: Under Section 68, certain forest officers can "compound" offenses by accepting a sum of money from the accused, which discharges them from further legal action.

  • Discussion on Severity: While the fines (e.g., ₹500) appear nominal by modern economic standards, the Act also allows for the seizure and confiscation of the produce, tools, boats, and cattle used in committing the offense (Section 52). Many states have also passed local amendments to significantly increase these fines and jail terms to act as a stronger deterrent against organized timber smuggling.
