Penalties under Maternity Benefit Act, 1961


The Act provides strict penalties for employers who fail to provide mandated benefits or discharge/dismiss a woman due to pregnancy.

  • Failure to pay maternity benefit: If an employer fails to pay the amount of maternity benefit or discharge/dismisses a woman in violation of the Act, they are punishable with imprisonment which shall not be less than 3 months but may extend to one year.

  • Fine: Along with imprisonment, a fine may be imposed ranging from $₹2,000$ to $₹5,000$.

  • General Penalty: For any other contravention of the Act or rules where no specific penalty is provided, the punishment is imprisonment up to one year, or a fine up to $₹5,000$, or both.
